18.1 - Disciplinary Authority and Lockdown Procedures
Detainees may be disciplined only for violations of rules listed in the detainee handbook or for violations of applicable law.
A correctional officer may initiate an automatic 24-hour lockdown for any Level I violation (first offense).
A mandatory maximum of 72 hours lockdown may be imposed for any Level II or Level III violation. Any lockdown exceeding 72 hours must be approved by a Lieutenant or higher authority.
If a detainee violates local, state, or federal law, the facility may also pursue criminal charges in addition to administrative discipline.
18.2 – Levels of Rule Violations
There are three classifications of violations: Level I, Level II, and Level III.
a. Level I Violations (Minor Violations)
Level I violations interfere with the orderly operation of the facility but do not pose an immediate threat to the safety or security of detainees, staff, or visitors. Level I violations carry a maximum of a 24 hour lockdown.
Level I violations include:
100 - Failure to stand for head count;
101 - Failure to comply with personal hygiene policies;
102 - Failure to maintain living quarters in accordance with Section 2 and Section 5;
103 - Failure to follow posted rules regarding visiting, telephone, and mail;
104 - Horseplay;
105 - Possession of unauthorized food;
106 - Excessive noise;
107 - Violation of posted rules for a specific area;
108 - Taking unauthorized items to recreation, visitation, programs, or court;
109 - Standing on banisters or railings;
110 - Covering air vents or hanging items on or from walls, fixtures, ceilings, bars, windows, or vents;
111 - Refusing or failing to attend work or scheduled activities;
112 - Improper use of intercom system;
113 - Improper use of kiosk/detainee inquiry system;
114 - Improper use of video visitation system;
115 - Misuse or abuse of detainee phone system;
116 - Failure To Properly Wear Jumpsuit/Uniform
117 - For trustee status detainees: violation of assigned rules not otherwise classified as Level I, II, or III;
b. Level II Violations (Major Violations)
Level II violations include repeated minor violations and actions that may seriously threaten the security, safety, or order of the facility. Level II violations carry a maximum of a 20 days on lockdown.
Level II violations include:
200 - Attempting or assisting another in committing an offense (treated as the offense itself);
201 - Fighting;
202 - Throwing objects or materials at a person;
203 - Lying in a disciplinary proceeding or formal grievance;
204 - Lying to a staff member;
205 - Refusing a direct order;
206 - Theft;
207 - Damaging government property (including light fixtures or covers);
208 - Gambling;
209 - Possession of alcohol or controlled substances;
210 - Possession of unauthorized drugs;
211 - Being under the influence of drugs or alcohol;
212 - Making intoxicants;
213 - Possession of contraband;
214 - Tampering with locks, alarms, or security devices;
215 - Obscene or abusive language or gestures (Sexual Harassment);
216 - Bribery or attempted bribery;
217 - Possession of drug paraphernalia;
218 - Possession of tobacco (Does apply to agency approved E-Cigarettes);
219 - Improper retention of medication;
220 - Possession of stolen property;
221 - Interference with staff duties;
222 - Possession of money;
223 - Abuse by words or gestures;
224 - Unauthorized transfer of property between detainees;
225 - Simple assault;
226 - Unauthorized group activity;
227 - Threatening any person;
228 - Failure to follow movement rules (Section 27);
229 - Unauthorized communication (inside or outside the facility);
230 - Disrupting or abusing programs, services, or visitation;
231 - Placing foreign objects in toilets or sinks / blocking plumbing;
232 - Attempting to flood any area;
233 - Defacing, altering, or misusing facility property;
234 - Jumping or hanging from banisters, railings, stairways, or fixtures;
235 - Interfering with lockdown or counts;
236 - Possession of tattooing equipment;
237 - Tattooing;
238 - Tampering with or altering electronic cigarettes;
239 - Two or more Level I violations from separate incidents within six months with formal reports;
c. Level III Violations (Serious Violations / Criminal Conduct);
Level III violations include acts that immediately threaten the safety, security, or order of the facility, and may constitute criminal offenses. Level III violations carry a maximum of a 45 days on lockdown.
Level III violations include:
300 - Attempting or assisting any Level III offense (treated as the offense itself);
301 - Homicide;
302 - Assault, assault with a weapon, or possession of a weapon;
303 - Hostage taking;
304 - Escape;
305 - Inciting A Riot or Rioting;
306 - Arson;
307 - Sexual contact or sexual assault;
308 - Extortion
309 - Forgery
310 - Conduct not specifically listed but constituting a felony or misdemeanor under local, state, or federal law;
311 - Two or more Level II violations from separate incidents within six months with formal reports;
