Section 22 - Access To Courts
22.1 – Purpose
To ensure that all detainees confined in the Randolph County Detention Center are afforded meaningful access to the courts in accordance with constitutional standards established in Bounds v. Smith and clarified in Lewis v. Casey.
22.2 – Policy
It is the policy of this facility to provide detainees with reasonable and adequate access to legal materials, legal assistance, and the courts, consistent with maintaining the safety, security, and orderly operation of the facility.
22.3 – Definitions
Access to Courts – The ability of a detainee to prepare, file, and pursue legal documents and actions.
Legal Materials – Court forms, statutes, case law, procedural rules, and other reference materials necessary for legal preparation.
Legal Assistance – Access to licensed attorneys, court-appointed counsel, or authorized legal aid services.
22.4 – Methods of Compliance
The facility shall provide legal access through a hybrid system consisting of the following components:
A. Legal Assistance
Detainees shall have access to:
Court-appointed attorneys
Public defenders
Private legal counsel
Attorney access:
Shall not be unreasonably restricted
Shall be conducted to preserve confidentiality
B. Legal Materials Access
The facility shall provide access to legal materials through a request-based system, which may include:
Alabama statutes (relevant portions)
Federal constitutional materials
Court rules and procedures
Standard legal forms (motions, petitions, etc.)
Materials may be provided via:
Printed copies
Electronic kiosk systems (if available)
C. Request Procedure
Detainees requesting legal materials shall:
Submit a written request form
Clearly identify requested materials when possible
Facility staff shall:
Respond within a reasonable timeframe, typically within 72 hours excluding weekends and holidays
Document all requests and responses
D. Special Housing Access
Detainees housed in segregation, lockdown, or medical units shall:
Retain the same legal access rights
Receive requested materials delivered to their housing unit when applicable
E. Indigent Detainees
Indigent detainees shall be provided reasonable supplies necessary for legal correspondence, including:
Paper
Writing utensils
Envelopes
Postage for legal mail to courts and verified legal correspondence
F. Notary Services
Notary services shall be made available upon request within a reasonable timeframe.
G. Legal Mail
Legal mail shall be:
Opened only in the presence of the detainee when inspection is required
Not read by staff
Processed in accordance with facility mail procedures
22.5 – Limitations
The facility may impose reasonable limitations on legal access to maintain safety, security, and order, including:
Limits on frequency or duration of access
Temporary suspension during emergencies, lockdowns, or security incidents
Denial of requests that are excessive, abusive, or unrelated to legitimate legal purposes
22.6 – Prohibited Activities
Detainees shall not:
Accumulate excessive legal materials that create safety or fire hazards
Provide legal services to other detainees for compensation
Disrupt facility operations under the pretext of legal activity
22.7 – Staff Responsibilities
Staff shall:
Process legal access requests in a timely manner
Maintain accurate documentation of all requests and responses
Ensure detainees are not interfered with in the exercise of lawful access to the courts
22.8 – Documentation
The facility shall maintain records of:
Legal material requests and responses
Legal mail processing
Any denied requests, including justification
22.9 – Compliance
This policy is intended to comply with constitutional requirements under Bounds v. Smith and limitations recognized in Lewis v. Casey.
22.10 – Review
This policy shall be reviewed annually and updated as necessary to ensure compliance with applicable law and operational requirements.
